The app is good, But I thought you'd be able to actually play Bin weevils on your phone. But anyway it's a good app. Maybe we could be able to train our Bin pets or be able to go about in our nest? This privacy policy ('Privacy Policy') describes how 55 Pixels Ltd, a private limited company incorporated in England (Company Number: 06221146), having its registered office at Lynton House 7-12 Tavistock Square, London, United Kingdom, WC1H 9LT (referred to herein as '55 Pixels' 'us' or 'we') collects, uses and shares the personal and non-personal information our players (who we refer to as Players) provide to us across the 55 Pixels Kids Platforms, including but not limited to the websites located at www.binweevils.com, www.weevilworld.com, the affiliated mobile application known as 'WeevilWorld' and any of the 55 Pixels Kids Platform services and features (collectively referred to herein as the '55 Pixels Kids Platform'). This Privacy Policy applies only to the 55 Pixels Kids Platform; it does not apply to any third-party websites or mobile applications to which we may link, nor to any advertisements which may appear within the 55 Pixels Kids Platform.

1. What we collect on the 55 Pixels Kids Platform

We do not purposely or knowingly collect personal information from you, except under limited exceptions set forth below. Information and content provided by Players goes through our moderation process, which includes technical analysis, automated text moderation, and trained, human moderators. The purpose of the moderation process is to remove any personal information or inappropriate content entered by Players before it is posted on the 55 Pixels Kids Platform or shared with other Players.

User Profile

Creating an account on the 55 Pixels Kids Platform does not require, or permit, the use of any personal information. When you sign up for the 55 Pixels Kids Platform, you create an anonymous account, including a username which is then publicly available inside the 55 Pixels Kids Platform. You may not use your real name, or any other information that could identify you or your location in the creation of your account or in posting content to 55 Pixels. Your 55 Pixels account contains:

  • Username, which may not contain your real name;
  • In-game Character;
  • Your membership status
  • Login status/recency

Plus the following which are not visible to other players:

  • Your Buddies in the 55 Pixels Kids Platform, but these are not visible to other players;
  • Information about your progress and position within the game

Chat and Messaging

Players can chat and message other players in a virtual public area. All chat and messages are moderated and filtered using best of breed moderation technology with human supervision and with tightly controlled kid-specific filtering rules.
Players may block any or all requests to become ‘Buddies’ and for direct chat/messaging.
Players can search for each other on the 55 Pixels Kids Platform with a username using the search and browsing tools on the 55 Pixels Kids Platform.

Communicating with Us

Players may also provide us with personal information by communicating directly with us. For example, if you choose, you may use one of our public email addresses to contact us. If you write to us (or otherwise contacts us), we may ask you to put us in contact with a parent or guardian, through whom we can then provide support. We may also ask you to prove to us that you are the parent of the owner of the Player account you are communicating with us about.
Consistent with the one-time use exception under the Children’s Online Privacy Protection Act, we only use players’ contact information to respond to inquiries, and we then delete Players’ email addresses from our servers.

Password Recovery

You have the option of providing a parent/guardian email address to enable us to recover your password if you forget it. When requesting a password reset, we will ask you for this email address. We will then anonymise the email address by ‘hashing’ it, compare the anonymised hashes of your email address to confirm your identity, and then send you a password reset link using (but not storing) the email address.

Other Non-personal information

We collect other non-personal information about Players whenever they interact with the 55 Pixels Kids Platform. Non-personal information includes the number and frequency of visitors to the 55 Pixels Kids Platform and the length of their stays and how they interact with the Platform, browser name, the type of computer, and technical information about the means of connection, such as the operating system. Information also includes player IP addresses, which we use solely for the internal support of the 55 Pixels Kids Platform, such as security, system administration, and in case requested by law enforcement.
Information (including stored chat and messages) relating to Players who do not have an active membership and who have not logged in to the 55 Pixels Kids Platform within two years is deleted at the next inactive data purge or sooner. Inactive data purges take place at least twice per year.

2. Why we collect information on the 55 Pixels Kids Platform

As set forth above, we collect personal information to serve our legitimate commercial business interests while protecting Players’ privacy. Specifically, we collect email addresses to allow us to respond to their questions or requests, including requests to reset user passwords; and we collect persistent identifiers (e.g., IP addresses) to support the internal operations of the 55 Pixels Kids Platform. We use the non-personal information we collect to improve Players’ experiences, and our products and services.

3. How we protect Player Information

55 Pixels takes reasonable steps to protect against possible breaches of the 55 Pixels Kids Platform. We adopt and implement appropriate and reasonable security practices regarding the collection, storage and processing of the information we collect, such as encryption. We also put in place physical safeguards such as limited employee access and confidentiality agreements with employees and contractors.
Despite our efforts, no security measure is ever perfect or impenetrable. In the event we experience a data breach involving unencrypted personal information, we will notify Players by posting notice on the affected 55 Pixels website or app.

4. Sharing Players’ Personal Information

We do not sell, trade, or rent your personal information to others, and will not do so except as required by law or in connection with a merger, asset sale or similar business transaction (as described below). We may share aggregated demographic or non-personal information not linked to any personal information regarding visitors and Players with our business partners, trusted affiliates and advertisers. Moreover, as set forth below, we use third-party service providers to help us operate our business and the 55 Pixels Kids Platform or administer activities on our behalf.

  • Internet service provider (ISPs): Your IP address is shared with ISPs to ensure legal or regulatory compliance.
  • OVH: https://ovhcloud.com/legal/privacy-policy. Used for Website and data storage.
  • Online.net: https://www.online.net/en. Used for website and data storage.
  • PayPal: https://www.paypal.com. If you choose to make purchases through the website, and pay with PayPal. 55 Pixels do not store any credit card or bank information.
  • Stripe: https://stripe.com/gb/privacy. If you choose to make purchases through the website, and pay by card. 55 Pixels do not store any card or bank information.
  • Helpshift: https://www.helpshift.com/legal/privacy. If you communicate with us for support we record the senders email address, the issue, and communications in the Helpshift support issue management system.
  • Sendgrid: https://sendgrid.com/policies/privacy. If a parent email address is entered or used to request a password reset, Sendgrid handles email deliverability.
  • OneSignal: https://onesignal.com/privacy_policy. If you have game-related push notifications opted-in, we use this system to send you game-related notifications.
  • Appsflyer: www.appsflyer.com/product/data-privacy. To identify where new players come to the 55 Pixels Platform from, we use Appsflyer. Your iOS or Android identifier, IP addresses and other technical data are used by Appsflyer to do this.

Law enforcement requests

We may disclose your personal information (a) in the good faith belief that we are required to do so by law; (b) if doing so is reasonably necessary to comply with legal process; (c) to respond to any claims; (d) to enforce the terms and conditions of the 55 Pixels Kids Platform; or (e) to protect the rights, property, or personal safety of 55 Pixels, its Players or the public.

Corporate Transaction

In addition, your personal data may be disclosed as part of any proposed or actual merger, sale, and transfer of 55 Pixels assets, acquisition, bankruptcy, or similar event.

5. Cookies and other tracking technologies

We may use cookies, local storage and other tracking technologies to collect information about visitors to the 55 Pixels Kids Platform and to help optimise their user experience. Cookies and local storage are a way of remembering a Player or visitor based on their device. Cookies are pieces of information that a website sends to a user’s computer while the user is viewing the website. A user can choose to have his or her computer warn the user each time a cookie is sent, or the user can choose to turn off all cookies. Players can do this through their browsers’ (e.g., Edge, Firefox, Chrome) settings. If a user turns off cookies, the user may not have access to certain features that make the web experience smoother.

We operate globally and may transfer your personal information to individual companies or third parties in locations around the world for the purposes described in this Privacy Policy. Any ads we serve will be delivered by ad serving technology which has been designed to be compliant with COPPA and is certified as such by the ESRB Privacy Certified and kidSAFE COPPA Certified, or other such certification programs. Such advertisements will only be targeted based on the context or content you are viewing on the 55 Pixels Kids Platform, and not on your historical browsing behaviour. All ads served in the 55 Pixels Kids Platform will carry the SuperAwesome SafeAd watermark, which indicates that (a) the ad is not collecting personal information in contravention of COPPA, (b) its content has been reviewed for compliance with best practice and the CARU self-regulatory principles to be appropriate for children, and (c) it is age-appropriate for the 55 Pixels Kids Platform. 8. Access, Modify, Delete and Other User Rights

Chat posted in the 55 Pixels Kids Platform may be publicly viewable during that player session. Should you wish to edit or remove any message/chat after it has been posted, you may contact us at [email protected] or using the information within Section 10 of this Privacy Policy. Removal of the information from public view does not guarantee complete or comprehensive removal, however. After the removal request has been honoured, we may retain copies of the messages/chat. Additionally, we do not have control over third parties (e.g., other Players) who may have copied or reposted this information.

9. Notice to California Residents / Your California Privacy Rights

Under California Civil Code § 1798.83, California residents are entitled once a year to request and obtain certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes during the immediately prior calendar year. 11. Revisions to Privacy Policy

Notices. No representation or warranty is made as to whether Bin Weevils and Weevils World complies with the regulatory regime and local laws of any other countries apart from the US and UK. Any legal matters that arise will be subject to the laws and jurisdictions of the courts of England and Wales.

Miscellaneous. 55 Pixels Limited may act as principal on its own account and not as agent for you or any other person. If 55 Pixels Limited does not enforce any provision of this agreement such will not be considered a waiver of any provision or right. In the event that any part of these terms and conditions is held to be unenforceable, such part will at 55 Pixels Limited's option be construed as far as possible to reflect the parties' intentions and the remainder of the provisions will remain in full force and effect. Use of Bin Weevils and Weevil World and these terms are subject to the laws of England and Wales which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licenses and conditions of use and shall be construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

These terms and conditions apply to all Bin Weevils and Weevil World users including Bin Tycoon users. These standard competition terms and conditions ('Terms and Conditions') will apply to all of the Promoter's competitions unless otherwise stated. Depending on the nature of the competition, it may be necessary to have additional terms and conditions ('Additional Terms and Conditions'), which will take priority over these Terms and Conditions.

The Promoter shall notify the entrants of any Additional Terms and Conditions that may apply to a competition. Entrants may enter the competition by following the directions given in respect of each competition.

  1. To enter all competitions you must be aged 16 years or under.
  2. All entrants must obtain parental consent prior to entering competitions.
  3. We may require proof of eligibility which may include the entrant to submit birth certificates or other proof of eligibility.
  4. Entrants must provide the details requested by the Promoter, which may include entrant's name, date of birth, age, address (including postcode), telephone number and/or email address.
  5. The competition is entered online on the Bin Weevils site or Weevil World and nowhere else.
  6. This competition is not open to employees (or members of their immediate families) of 55 Pixels Limited.
  7. The Promoter is not responsible for any and all expenses in connection with the prize including but not limited to transportation.
  8. No purchase necessary.
  9. Only one entry per household per competition.
  10. Any personal information (entrant's name, age, address, telephone number and/or email address will be used solely in connection with this competition and will not be disclosed to any third party, except for the purpose of fulfilling the prize where applicable. Any personal information held by the Promoter in respect of the competition will be held on record for a short period for the purpose of ensuring fulfilment of the competition.
  11. The winner(s) will be selected at random by 55 Pixels Limited from correct and eligible entries. Their decision is final and no correspondence will be entered in to over this decision.
  12. If a winner has already won any prize on Bin Weevils or Weevil World within the past 3 months, then another winner will be selected.
  13. Closing Date: The closing date shall be the date and/or time given in the instructions or shown on the page for the competition, unless otherwise stated.
    We will not enter into any correspondence regarding entries received after this date. No responsibility is accepted for late or lost entries due to the internet or other. Proof of sending is not proof of receipt. 14. For question and answer based competitions, the winner will have answered the question correctly. A random selection of potential winners will be chosen and the entrants will be emailed asking for their address details and must seek parental consent before replying, from this selection, the winner(s) will be randomly selected and sent the prize stated.
    For skills based competitions, such as designing and/or story writing competitions or performing challenges or completing hunts, the winner(s) will have successfully completed the required skills based task and will be the person(s) whom the Promoter judges to have performed such task the best from all the entries received or in hunt cases, a selection of random winners who found all items will be selected and emailed asking for their address details and must seek parental consent before replying, from these, the winner(s) (as stated in the competition) will be randomly selected and sent the prize stated. The Promoter's decision is final.
  14. In the event that the Promoter cannot for any reason contact the winner within 7 days of the first draw then the promoter reserves the right to randomly draw another set of winners.
  15. If you do not claim your prize within 7 days we reserve the right to offer the prize to another successful entrant whose name is next drawn at random.
  16. You can find out who won by sending a stamped addressed envelope to 55 Pixels Limited, 2nd Floor, 17-18 Great Pulteney Street, London W1F 9NE, UK after the competition closing date.
  17. The prize and quantities are stated on the individual competitions.
  18. No part of the prize is exchangeable for cash or any other prize. However we reserve the right to award a substitute prize of equal value. No cash alternatives will be offered.
  19. By entering the competition, the winners of any prize agree to participate in such promotional activities and feature in such promotional material as Bin Weevils or Weevil World may require.
  20. If circumstances arise outside of our control we reserve the right to cancel the competition at any stage.
  21. The Promoter is committed to a strict privacy policy.

  23. These competition Terms and Conditions shall be governed by and constructed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising.

III. ADDITIONAL TERMS

Bin weevils membership accounts. Apple and Google Additional Terms. The following additional terms and conditions apply with respect to our applications designed for use on an Apple (iOS) & Google (Android) powered mobile devices ('App'):

  1. You acknowledge that these terms of use are concluded between you and us only, and not with Apple, Inc. ('Apple') or Google ('Google'). We, and not Apple or Google, are solely responsible for our App and the services and Content available thereon.
  2. You agree that your use of our App shall be subject to the Usage Rules set forth in Apple's and Google's then-current App Store Terms of Service.
  3. The parties agree that Apple and Google shall have no obligation to provide maintenance and support services with respect to our App.
  4. To the maximum extent permitted by applicable law, Apple and Google will have no warranty obligation whatsoever with respect to our App.
  5. You agree that we, and not Apple or Google, are responsible for addressing any claims by you or any third party relating to our App or your possession and/or use of our App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
  6. You agree that we, and not Apple or Google, shall be responsible for the investigation, defence, settlement and discharge of any third party intellectual property infringement claim related to our App or your possession and use of our App.
  7. You agree to comply with all applicable third party terms of agreement when using our App (e.g., you must not be in violation of your wireless data service terms of agreement when using the App).
  8. The parties agree that Apple, Google their subsidiaries are third party beneficiaries to the terms of use applicable to our App. Upon your acceptance of the terms of use, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce the terms of use against you as a third party beneficiary thereof.
  9. Refunds:All sales are final. No refunds will be given for in App Purchases except in the event of a system error.
  10. Unauthorised Purchases:In the instance of unauthorised charges, refund requests that are received within thirty (30) days of the initial purchase are eligible for a full refund, provided the Weevil World player account has logged in and played three or fewer times. No unauthorised purchase refunds will be given after thirty days from the date of purchase, or if the player account has four or more plays.
    In the case of a game account that reports an unauthorised purchase and receives a refund, the account will then be permanently banned from accessing the app as a security measure.
  11. iTunes App Store Purchases:We are not able to refund transactions made through the iTunes (Apple) store. All transactions are processed by Apple. Customers will need to contact iTunes directly fora any and all refund requests. Please see the iTunes Store Terms of Service for more information here.

  13. Refunds:All sales are final. No refunds will be given for in App Purchases except in the event of a system error.
  14. Banned accounts:Weevil World accounts that have received a permanent banned account for violating the Weevil World rules will NOT be eligible for any refunds.
